Terms and Conditions
1. Scope of Campaign
AEGEAN AIRLINES S.A., with registered office at the International Athens Airport, Building 57, Spata, Attica, (hereinafter: “Organiser”), launches a promotional campaign entitled “Share The Rare Quiz” (hereinafter: “Campaign”).
To implement and publicise the Campaign, the Organiser has partnered with “Atcom SA” (“ATCOM”), a company actively engaged in advertising, with registered office at 24, Averoff Str., GR-142 32, Athens [Tax Registration No. 09987570, Athens Tax Office for Corporations (“FAE”)] (hereinafter: “Aegean Partner”).
The Campaign will run via the website https://en.aegeanair.com/share-the-rare/. It will start on 27 September 2023 at 10:00 (EET) and it will end on 31 October 2023 at 23:59 (EET). In particular, using promotional material posted on aegeanair.com and media advertising, the Aegean Partner shall invite users to visit the website https://en.aegeanair.com/share-the-rare/, - a website specifically created for the purposes of the Campaign, with a view to offering suggestions on travel destinations in Greece - in order to do #sharetherare based on their traveller profile. The Campaign will run in the UK, France, Austria, Switzerland, Austria and Israel. Once it is completed, all users meeting the participation requirements will receive a 20% discount on their next booking, through a special discount code they will receive at the email address they have registered in the consent form.
To be eligible to participate in the Campaign, users must fill in their personal details on the above website and agree to the Terms and Conditions of Participation in the Campaign. The personal details that need to be filled in are:
Title, Name, Surname, Email, Nationality, City, Country, Preferred Airport (optional), Date of Birth. Users may optionally consent to receiving informative and promotional material. In any case, failure to accept the Terms and Conditions of Participation leads to automatic exclusion of the user.
Once the above information is completed, the user starts playing the Energy quiz. The user will have to answer 5 multiple-choice questions including photos. In each question, the user will have 3 available answers to choose from, in order to move on to the next question. After answering all 5 questions and completing the quiz, each user will view a brief description of his traveller profile (authentic, sophisticated or explorer), depending on his/her answers. At the same time, Greek destination suggestions will be displayed on his/her screen, to do #sharetherare based on their traveller profile. Following the above, the user has to fill in his/her details and accept the Terms and Conditions in order to receive a 20% discount on his/her tickets to Greece. The photos of the answers and some of the questions will change every week. Each user may participate in the Campaign with the same email only once.
2. Registration
Once registered successfully, users shall automatically receive a confirmation email from the Organiser at the email address stated in the registration form. Such confirmation email will include the result of his/her traveller profile and a 20% discount code to book a ticket to any destination in Greece from/to England, France, Austria, Switzerland and Israel.
The Organiser shall bear no responsibility nor assume any obligation with regard to securing or facilitating access to internet sites or providing the relevant facilities to any interested parties with respect to their participation in the Promotion. Access to the Campaign is subject to the operating terms and conditions of the relevant server and to the technical and other conditions and specifications of the Campaign. The Organiser considers that each participant is the true holder of, and has exclusive control over, the personal data provided. The Organiser shall not be liable for any charges levied on the participants/users from the above causes.
3. Eligibility
Any persons falling into the following categories are excluded from the Campaign:
(a) Anyone under the age of 18;
(b) Anyone who has expressly not agreed to these Terms and Conditions;
The Organiser and the Aegean Partner shall bear no liability vis-a-vis third parties for any unauthorised use of the service envisaged herein. The Organiser reserves the right (but has no obligation) to exclude from the Campaign, at any stage thereof, any persons who, in the Organiser’s opinion, may have used (or tried to use) unlawful means in relation to their participation in the Campaign or breached any terms of this Article.
"Unlawful means" shall mean, inter alia, cooperation with other persons, use of devices, arrays, computers and/or software to facilitate automated or multiple participations without human intervention, etc. In any case, the Organiser may exclude from the Campaign any user/visitor/participant who uses any lawful means.
It is further specified that participation in the Campaign is not conditional upon purchase of any product(s) or payment of any fees on the part of the participants.
Participation in this Campaign requires that users have unlimited access to the Internet by their own technical equipment; they participate voluntarily and have accepted the Terms and Conditions of Participation in the Campaign.
Each user may participate with their email address only once. “Participation” means valid submission of the registration form, as outlined in paragraph 1 above.
4. Discount Codes
The Campaign starts on Wednesday, 27 September 2023 at 10:00 (EET) and ends on Tuesday 31 October 2023 at 23:59 (EET). After completing the quiz, each user will instantly receive an email at the email address he/she stated during registration, including a discount code as a reward for participating in the Campaign.
5. Discount Code Terms and Conditions
Discount codes are subject to the following conditions:
- The discount code is valid for all direct and stopover return flights from/to England, France, Austria, Switzerland and Israel to/from any destination within Greece, operated by AEGEAN and Olympic Air.
- Flights under the same flight number are excluded.
- The discount code is valid for Economy and Business class fare bookings made until 31/10/2023 via aegeanair.com, olympicair.com or the AEGEAN app.
- The discount code is valid for flights from 27/09/2023 up until 31/03/2024 and only when all the flights included in the booking are between these travel dates.
- The 20% discount shall only apply if the code SHARETHERARE is entered in the “Discount Code” field on the booking page. It may not be combined with another discount code.
- Only one discount code can be used for each booking.
- The discount code may only be used once and is linked to the email address of the Campaign participant.
- No restrictions apply as to the number of passengers per booking.
- The discount only applies to the fare and is not applicable to the full value of the ticket.
- The discount does not apply to taxes.
- The discount applies to purchases made in euro (€) or GBP.
- If the booking is cancelled, a refund policy applies depending on the fare class.
- Ticket changes are subject to the regulations applicable to the fare.
6. Start/end Date – Duration
The Campaign starts on Wednesday, 27 September 2023 at 10:00 (EET) and ends on Tuesday 31 October 2023 at 23:59 (EET). The Organiser’s computers shall be the official timer of the Campaign defining the Start Time, the End Time, the time of active submission of entries and display of entries on the app. It is explicitly stated that after the end date of the Campaign, as same will be stated in the Terms and Conditions of Participation on the Organiser’s website, no more entries will be accepted by the Organiser and no entries will be binding upon the latter as far as timely submission is concerned.
7. Changes to Terms and Conditions
The Organiser reserves the right to amend these Terms and Conditions at its free discretion, by informing visitors/users through the Campaign website (https://en.aegeanair.com/share-the-rare/terms-and-conditions/).
8. Express Declaration – Consent – Acceptance by Participants
All participants in the Campaign hereby fully and unreservedly accept these Terms and Conditions of Participation. Any persons not having accepted these Terms and Conditions shall not be eligible to participate in the Campaign. Furthermore, all participants explicitly and unreservedly acknowledge, state and accept that:
(a) The personal data provided in the context of this Campaign shall not belong to third parties, whether natural or legal persons, but only to the participants themselves;
(b) They commit no personal data breach or any breach of the privacy rights of third parties;
(c) They breach no intellectual property rights of third parties.
9. Publicity
The Terms and Conditions of Participation in the Campaign have been placed on file with Athens Notary Haralambos Fotopoulos and posted on the Campaign website (https://en.aegeanair.com/share-the-rare/). Any participant in the Promotion or any third party may obtain an exact copy of that deed at own expense.
10. Withdrawal of Notice - Amendment of Terms - Liability
The Organiser shall have a right to withdraw the Campaign notice in whole or in part or amend these Terms and Conditions (including, without limitation, the Campaign duration).
The Organiser may under no circumstances be held liable for any direct or indirect losses, expenses or costs which may arise from any interruption, disruption, delay of the Campaign or from any other cause related to the Campaign.
Moreover, the Organiser shall bear no criminal or civil liability vis-a-vis any participants or third parties for any accidents which may occur and/or loss and/or physical or material harm which may be suffered by them directly or indirectly in connection to their participation in the Campaign or from any other causes.
It is expressly specified that, once the Campaign is completed or after the new End Date to be set following postponement or change in the Campaign duration, no entries shall be accepted. Any entries submitted thereafter shall be automatically considered null and void and shall not be binding upon the Organiser and/or any third parties. In this regard, by participating in the Campaign, participants irrevocably accept that they do hold no rights or claims against the Organiser nor become entitled to demand continuation of the Campaign after it is ended or claim further damages.
11. Trademarks – Intellectual Property
Participants neither have nor acquire any rights whatsoever in or over any trademarks, names, marks, logos or other insignia of the Organiser or the Aegean Partner.
12. Applicable Law- Jurisdiction
These Terms and Conditions and any contractual or other relations arising as a result of their implementation shall be governed by Greek law as far as all participants are concerned. Any dispute to arise from or in connection with the Campaign shall fall under the exclusive jurisdiction of the Courts of Athens, Greece. This applies also to disputes not involving Greek citizens.
By participating in the Campaign participants state that they have gained thorough knowledge of all Terms and Conditions applicable to the Campaign and that they accept such Terms unconditionally in their entirety.
ANNEX – "STATEMENT OF CONSENT"
Participants state that they have gained thorough knowledge of all Terms and Conditions of the Campaign and that they unconditionally accept such Terms in their entirety. Each participant states that he/she holds no claims whether already effective or to gain effect in the future, against the Organizer, the Aegean Partner and against their executives, employees or performance agents with respect to the implementation of the Campaign, the implementation of its Terms and Conditions or any other cause relating directly or indirectly to the Campaign. Each participant explicitly consents and agrees to the assignment and full and final transfer to the Organizer and ATCOM, of any and all intellectual property rights or related rights over the visual material described above, free of charge. The Organizer and ATCOM shall have a right to exploit such visual material in any manner for the purpose of creating on- and off-line advertisements, on the internet and/or in the Press or on television. DATA PRIVACY STATEMENT
AEGEAN AIRLINES S.A. with registered office at the International Athens Airport, Building 57, Spata Attica (hereinafter the “Company”) is the Data Controller of your personal data in the context of your participation in the promotional campaign entitled “Share The Rare - Quiz”. As our strategic objective is to ensure that the data of participants enjoy maximum protection, we feel obliged to inform you both about our practices and about your rights and remedies.
I. What personal data do we collect?
To allow you to participate in the Campaign, we collect and processes the personal data set forth in Article 1 hereof.
II. For what purposes is personal data collected and processed?
We only collect and process your personal data for the purpose of enabling you to participate in the Campaign and also to identify you, to make announcements and to contact you to deliver any prizes you may have won.
III. Who is your personal data disclosed and/or transmitted to?
We may transfer, disclose or grant access to your personal data to companies conducting business on our account, as part of our business objects.
VI. How is the security of your data ensured?
To ensure the legitimate use and the integrity of your data and prevent any unauthorised or accidental access, processing, deletion, corruption or other use thereof, we have various internal policies in place, take all organisational, technical, physical, electronic and procedural measures necessary and apply technological standards consistent with the applicable laws and regulations.
VII. How long is your data retained for?
We retain your personal data for as long as it may be necessary to complete the Campaign, in any case for as long as it may be considered essential to complete the game and/or the actions you have consented to. After that date, your data is deleted from our records and systems, in compliance with our corporate policies, provided that retention is no longer required to meet the purposes outlined above or to meet any business, tax or accounting requirements or defend our rights before any competent courts or Authorities.
VIII. What rights do you have as data subjects?
You have a right to request and receive access to, update, and obtain a copy of your personal data which we collect and process. If you wish to obtain a copy of all or part of your personal data, please contact us at the contact details set out in section “IX. Contact us” hereof.
We would also like to inform you that you have the right to demand erasure of your data, if (a) your data are no longer required to fulfil our contractual obligations towards you; (b) your data has undergone unlawful processing for purposes other than those thoroughly set out herein; (c) this is required by law or (d) the date specified in term VII hereof has elapsed.
You are also entitled to withdraw your consent (in whole or in part) to the collection and processing of your personal data by us with regard to the Campaign. In that case, you need to bear in mind that the withdrawal of your consent does not howsoever impair the legality of any processing performed up to that point. You may therefore freely withdraw any or all consent given at any time, by filing a written request to that effect at the email address stated in section “IX. Contact us”. If consent is withdrawn, we will take reasonable measures to inform third party processors who have processed your data.
