Terms & Conditions

The terms and conditions for this competition have been deposited with Athens-based notary public Haralambos Fotopoulos, 47 Solonos St., GR-10672, tel. 210 3617704, and Deed No 491/3.12.2015 has been drafted regarding the deposit of the Terms and Conditions of Participation in the Competition.

1)Scope of the Competition – Organization
The company with the corporate name AEGEAN AIRLINES S.A. (hereinafter the “Organizer”), whose registered offices are at 31 Viltanioti St., Kifissia, Attica, is organizing a «Register and Win» online competition (hereinafter the “Competition”) which will start on Monday December 7 at 13:00 hours (local GR time) and will end on Wednesday, January 20th, 2016 at 12:00 hours (local GR time). The prizes are:

Α) 2 winners from Greece will win a 5 days trip for 2 persons at KITZBŰHEL; Austria. The prize includes:

1. Business class round trip tickets with Aegean to Munich airport.
2. Private transfer with Mini Van from/to KITZBŰHEL.
3. 4 Overnights at a 4*or 5*Hotel in Tyrol Austria with daily breakfast.
4. 2 days private Ski course or 5 hours duration.
5. 2 days Ski passes.
6. 2 days rental of Ski equipment.
7. Spa treatment at the hotel (massage treatment or other).
8. Dinner at the hotel.
9. Horse carriage ride in Kitzbühel of 1 hour duration.
10. Candlelight Dinner at a local restaurant, with 3-course set menu & wine.

Β) 6 winners from Germany, France, UK, Italy, Russia and Cyprus will win a 4 days trip for 2 persons in Athens, Greece (1 winner for each country). The prize includes:

1. Business class round trip tickets with Aegean to Athens airport.
2. Private transfer from/to the hotel.
3. 3 overnights at a 4* city hotel in Athens with daily breakfast.
4. Private guided tour in Athens with licensed guide and entrance fees to Acropolis & Acropolis Museum.
5. Lunch at Mikrolimano in a local seaside fish restaurant.
6. Private guided tour at the National Archeological Museum with licensed guide and entrance fees to Museum.
7. Coffee break at Lycabettus Hill including round trip tickets to Cable car.

Manessis Travel (Manessis A.T.E.Ξ.Ε. Filelinon 4 Postal Code 10557 Athens, Greece), as a co-organizer company, is the sole responsible for organizing the travel packages.

The Organizer hereby invites those visitors of Aegean website www.aegeanair.com that register to Miles + Bonus, the common frequent flyer program of Aegean and Olympic Air, within the validity period of the competition, stating in the registration’s contact details Greece, Germany, France, England, Italy, Russia or Cyprus as their home country, to enter a draw to win

• Two (2) winners from Greece (Greece stated as a country residence) win a 5 day trip for two persons to KITZBŰHEL
• One (1) winner from each country: Germany, France, England, Italy, Russia and Cyprus (total of six winners), win a 4 day trip to Athens for two persons.

The eight (8) winners that will emerge from a draw are required to provide an identification document that validates the personal data by which they registered to Miles+Bonus. The draw will take place on January 21st, 2016 at 12:00 hours (GR local time) and the web tool to be used for the draw is http://random.org. The winners must be identified as new and unique Miles + Bonus members who registered during the validity period of the Competition, stating as a country of residence, each of the participating countries (Greece, Germany, France, England, Italy, Russia and Cyprus).

2) Eligibility
Anyone over the age of 18 residing in any of the above mentioned countries may participate in the Competition.
Individuals falling into the following categories are excluded from the Competition:
(a) anyone under the age of 18.
(b) anyone who has not agreed to these terms and conditions of use.
(c) the employees of the Organiser
(d) first- and second-degree relatives of the employees referred to in paragraphs (c) and and the spouses of said employees.
(e) existing Miles+Bonus members
(f) Miles+Bonus members with multiple registrations
In such cases, the aforementioned companies shall not be liable to anybody due to inappropriate use of this service.
The Organizer reserves the right (but is not required) to exclude from the Competition, at any stage of the competition, persons who, in its view, may have used (or attempted to use) unlawful means regarding their participation or who breach a term of this article.
Unlawful means shall mean, inter alia, cooperation with other persons, use of devices, arrays, computers and/or software to facilitate automated or multiple participations without human intervention, etc.
In all events, the Organizer may exclude any underage user/visitor/participant from the Competition using any lawful means.
It is hereby specified that participation in the Competition does not require purchase of any product and that no fee is to be paid by the participants.
Participation in this promotion is conditional upon access of the participants to the Internet using their own technical means. It shall be voluntary and requires prior agreement of the participants with the terms of the Competition.

3) Prizes – Draw
After the end of the competition two (2) trips to KITZBŰHEL- Austria departing from Athens, will be drawn as well as six (6) trips to Athens-Greece, each departing from Germany, France, UK, Italy, Russia and Cyprus.
To select the winners an online draw will take place.
The draw will take place at the premises of Aegean, 31 Viltanioti str. Kifisia 14564, at 12:00 hours (local GR time) on Thursday 21/01/2016. Each draw will name one (1) winner and one (1) substitute for each participating country (Germany, France, UK, Italy, Russia and Cyprus) and two (2) winners and two (2) substitutes for KITZBŰHEL- Austria destination with travel starting from Greece.
The processing of the participations and the organizing of draw will be done by the Organizer. The web tool to be used for the draw is http://www.random.org/.
The winner of the Competition may not designate a substitute to receive the prize nor request exchange of the prize for money or any other replaceable items.

If it is not possible to communicate with the winner for any reason for up to 5 business days from the date of the draw (including as a result of chance and force majeure events), then the Organizer is released from any obligation towards that specific winner. Automatically, the winner will be the substitute of the draw for each of the seven countries participating in the contest. If it is not possible to communicate with the substitute for up to 5 business days from the date of the draw (including as a result of chance and force majeure events), then the Organizer is released from any obligation towards that specific substitute.
Where the Organizer does contact the winner, he/she will be asked over the phone to provide the minimum personal data necessary so that all further steps can be taken (announcement, dispatch of prize, etc.). It is hereby specified that award of any prize to the winner shall furthermore depend on the condition precedent that the winner produces and demonstrates to the Organizer the details referred to in this clause (production of ID card) within the time limit set; otherwise, the relevant prize shall not be awarded.
Contestants are responsible for the full and proper completion of their quote and submission of their data. In case of fake or inaccurate stated data, other than those listed in the official identification document; winners automatically lose the right to collect gifts. In such case, the substitute is automatically defined as a winner, for each of the seven countries participating in the Competition.
The Organizer reserves the right to announce the names of the winner through Social Media, SMS, publication in magazines, newspapers, on the Internet and at the company’s offices. By participating in the Competition, participants are presumed to have granted their consent to such disclosure of their names.
To avoid all doubt, no participant shall be considered, or may claim to be, a final winner, in accordance with these terms, unless delivery of the prize (tickets) to him/her has been completed in accordance with the terms contained herein. Any publication of the result of a draw or of the name of an alleged winner on the Competition webpage does not make the result final nor does it establish any claim for any such person.

4) Prize terms and conditions

• The travel must be realized on the same dates by the winner and the companion of his choosing.
• The winners must notify Aegean in written, for the desired date of the trip at least 10 working days before the date they wish to travel. The travel may be used within the period of 02-02-16 to 15-04-16.
• It is expressly agreed that the prize tickets cannot be sold, or exchanged with money. The airline tickets only pertain to flights operated by AEGEAN AIRLINES and it is not possible to change the airline.
• Any prize not used for any reason will be cancelled and the winner may not claim any other prize or any compensation or remuneration.
• The Airline’s liability is limited in accordance with the applicable Greek and International legislation.

5) Date of start/end of competition/promotion – Duration
The Competition will start at 13:00 hours (GR local time) on Monday, December 7th, 2015 and will end at 12:00 hours on Wednesday, January 20th, 2016. The Competition Computers shall be the official timer of the Competition determining the Start Time, the End Time as well as the time of active sending of an entry or apparent receipt by the application of a Competition entry.
It is hereby expressly stated that, after the end date of the aforesaid Competition, as announced in the terms and conditions of use of the Organizer’s page, no entry will be accepted by, or be binding upon, the Organizer in relation to whether the entry was submitted in good time or not.

6) Change of Terms and conditions of use
The Organizer reserves the right to amend these terms at its discretion, informing visitors/users about any amendments and changes through the Competition/promotion webpage at https://twitter.com/aegeanairlines.

7) EXPRESS DECLARATION – CONSENT – ACCEPTANCE BY THE PARTICIPANTS
All participants in the Competition hereby fully and unreservedly accept these terms and conditions of use. Persons who do not accept the terms and conditions of use should not participate in the Competition.
Furthermore, all participants explicitly and unreservedly acknowledge, state and accept that:
(a) the personal data provided in the context of this promotion may not belong to any third party, whether a natural person or legal entity, but only to themselves;
(b) they are over the age of 18;
(c) their personality rights are neither infringed nor degraded in any manner whatsoever due to their participation in such promotion by the Organizer, in which they participate using their personal data, as published on their twitter account;
(d) they do not infringe personal data or personality rights of any third party;
(e) they do not infringe intellectual property rights of any third party;
(f) they expressly agree to the Organizer using their personal data (full name, telephone, e-mail address) for the purposes of the Competition;
(g) they grant their consent and authorization to the Organizer to promote the Competition and its results through the traditional and electronic press and through the Internet for its entire duration. The Organizer reserves the right to use and publish any news relating to the Competition which was run.
(h) they grant their consent and authorization for exploiting any relevant event through advertising, without requiring any further notice or any compensation. The Organizer also reserves the right to publish audiovisual material from the draw and the prize-giving event.

8) Publicity
The terms of participation in the Competition have been deposited with notary public Haralambos Fotopoulos, 47, Solonos St., Athens 10672, tel. 210 3617704, and have been posted on the website of Aegean www.aegeanair.com. The draw will take place at the Organizer’s offices.
Any participant in the Competition or any third party may obtain an exact copy of this deed at own expense.

9) Withdrawal of Notice – Amendment of Terms - Liability
The Organizer shall be entitled to withdraw the Competition notice, in whole or in part or to amend these terms (including the duration of the Competition and the dates of conduct of the draws), or to exchange the prize offered (tickets) with another of an equal value during or after the Competition. In this case the Organizer shall bear no liability whatsoever for any compensation with regard to the winners of that draw.
The Organizer shall bear no liability under any circumstances for any direct or indirect losses, expenses or costs which may arise from any interruption, malfunction, delay or any other reason, concerning the Competition prizes. Furthermore, the Organizer hereby waives all liability, whether criminal or civil, to any winner or third party, for any accident and/or loss and/or bodily injury or material damage that may occur to the winners, directly or indirectly, relating to the prize or arising from any other cause.
It is expressly understood that, after the end of this Competition or after the new date that may be set following any postponement or change in the duration of the Competition, entries shall no longer be possible and any entries submitted shall automatically be considered null and void and shall not be binding on the Organizer and/or any other third party. In that case, by participating in this promotion, participants irrevocably accept that they do not acquire any right or claim against the Organizer nor do they become entitled to demand continuation of the Competition that has ended or delivery of the prizes not awarded or any further compensation.

10) Trademarks – Intellectual Property
Participants shall neither have nor acquire any rights whatsoever in respect of the trade marks, names, marks, logos and other insignia of the Organiser.

11) Personal Data - EXPRESS Consent – Re the Organizer
Participation in the competition entails the provision of explicit and unreserved consent of each Participant to the company so that the company can register their personal data in a file that will keep within the meaning of Law 2472/1997, as in force, of Law. 2774 / 1999 and the Decisions and Directives of the Data Protection Authority. Participants are entitled to object at any time to the processing of their data and can do so by notifying Aegean. The participants also agree and consent to the use of their data for direct advertising and communication purposes. Participants neither have nor acquire any right whatsoever on the brands, names, emblems and other distinguishing signs of Aegean.

12) Consent to use of visual material
By participating in this action you consent and authorize the Organizer to promote the action and/or its results through the radio, the television, the press, on-line media or through the Internet (including through the social media). Hence, the organizing entities reserve the right to use and publish for advertising purposes the list of winners or articles accompanied by photos and to potentially use any information relating to this promotional action for advertising purposes. By participating in this action you automatically consent to the above actions and assign all necessary intellectual property rights free of charge.

13) Applicable Law - Jurisdiction
These terms and any contractual or non-contractual relationships arising from their implementation are governed by the Greek Law in respect of all participants. Any dispute to arise in the future in relation to this Competition shall be referred exclusively to the Courts of Athens, including by non-permanent residents of Greece.

By participating in this promotional action you state that you have gained thorough knowledge of all Comprehensive Terms of the Programme and that you unconditionally accept such Terms in their entirety.

ANNEX – "STATEMENT OF CONSENT"

1. Participants state that they have gained thorough knowledge of all Comprehensive Terms of the action and that they unconditionally accept such Terms in their entirety.
2. Each participant states that he/she holds no claims whether current or future, against Aegean or its executives, employees or performance agents with respect to the conduction of this promotional action, the implementation of its terms or any other cause relating directly or indirectly to the promotional action.
3. Each participant explicitly consents to and agrees to the simultaneous assignment and full and final transfer to Aegean Airlines, free of charge, of any and all intellectual property rights or related rights over the visual material described above. Aegean Airlines shall have the right to exploit such material in any manner for the creation of on- and off-line advertisements, for the Internet and/or for the press or the television. By submitting a request for participation and publication of the visual material, participants assign to the companies all permits necessary for any exploitation of the photographs (visual material) and for their presentation to the public, indefinitely, globally and without consideration.
4. Participants hereby acknowledge and agree that the organizing entities shall have all powers arising from the audiovisual material, including the right to transfer same to third parties, whether natural persons or legal entities, at their free discretion. Participants hereby consent to the companies' authority to introduce such modifications, changes or additions to the audiovisual material described above as they may consider appropriate.
