TERMS AND CONDITIONS OF PARTICIPATION

The terms and conditions for this Competition have been deposited with Athens-based notary public Haralambos Fotopoulos, 47 Solonos St., GR-10672, tel. 210 3617704, and Deed No 775/13.12.018 has been drafted regarding the deposit of the Terms and Conditions of Participation in the Competition.

1. Scope of the Competition – Organisation
The company with the corporate name "AEGEAN AIRLINES S.A.", whose registered offices are at 31 Viltanioti St., Kifissia, Attica (hereinafter the "Organiser"), is organising a “Your wish can take you miles away" competition / promotion (hereinafter the "Competition"), through its website http://www.aegeanair.com. The competition / promotion will start at 15:00 hours on Thursday, 13 December 2018 and will end at 12:00 hours on Wednesday, 2 January 2019, and two hundred (200) lucky winners will be chosen by draw on Tuesday, 3 January 2019.

The Organiser invites the visitors of Aegean’s website (www.aegeanair.com) that will register to AEGEAN Miles+Βonus or sign in to their AEGEAN Miles+Bonus account throughout the duration of the competition, to participate in a draw, after reading the complete terms and conditions of the Competition here (https://en.aegeanair.com/milesandbonus/about-the-program/christmas2018_terms/).

The 200 winners of the draw to be carried out by AEGEAN via www.random.org on 3 January 2019, at 15:00 hours, must provide proof of identification with respect to the information they entered upon registration to AEGEAN Miles+Bonus. The winners must be AEGEAN Miles+Bonus members that registered or signed in to their account during the Competition, wrote their wish and stated that they wish to participate in the draw.
The competition will be held exclusively via the internet, by filling in the AEGEAN Miles+Βonus registration form or signing in to an existing Miles+Βonus member account. Each participant can enter the draw only once.

The Organiser assumes no obligation to secure or facilitate access to Internet sites or to provide the relevant facilities to any interested party with respect to their participation in the Competition. Access to the Competition website is only permitted under the operating terms and conditions for the relevant server and the technical and other conditions and specifications for the Competition. The Organiser hereby assumes that each participant is the subject of, and has exclusive control over, the personal data he/she provided. The Organiser shall not be liable for any charges to the participants/users due to the aforementioned grounds.

2. Eligibility
Anyone over the age of 18 is eligible to participate in the promotion / Competition.
Individuals falling into the following categories are excluded from the Competition:
(a) anyone under the age of 18;
(b) anyone who has expressly not agreed to these terms and conditions of use;
(c) employees of the Organiser;
(d) the employees of the Organiser’s affiliates, and
(e) first- and second-degree relatives of the employees referred to in paragraphs (c) and (d) above and the spouses of said employees.
In such cases, the aforementioned companies shall not be liable to any individual due to inappropriate use of this service. The Organiser reserves the right (but is not required) to exclude from the Competition, at any stage of the Competition, persons who, in its view, may have used (or attempted to use) unlawful means regarding their participation or who breach a term of this article. "Unlawful" shall mean, inter alia, cooperation with other persons, use of devices, arrays, computers and/or software to facilitate automated or multiple participations without human intervention, and so on.
In all events, the Organiser may exclude any user/visitor/participant from the Competition using any lawful means.
It is hereby specified that participation in the Competition does not require purchase of any product and that no fee is to be paid by the participants.
Participation in this promotion is conditional upon access of the participants to the Internet using their own technical means. It shall be voluntary and requires prior agreement of the participants with the terms of the Competition.

3. Prizes - Draw
The Competition winners will receive the following prizes:
• 30.000 award miles for the 200 winners, that will be credited in their Miles+Bonus accounts.
• The wishes of the 200 winners will be written on the head rests of selected Aegean flights during January.

Winners will be selected through an electronic draw from among all entries. The draw will be held at Organiser’s offices at 31 Viltanioti St, GR-14564 Kifissia, on Tuesday, 3 January 2019, at 15:00 hours. Two hundred (200) winners will be selected. The Organizer will process the entries in the competition and conduct the draw for the winners. The web tool to be used for the draw is http://www.random.org/.

Any participant can be declared a winner only once and receive his/her Prize only once. The winner of the Competition may not designate a substitute to receive the Prize nor request exchange of the Prize against money or any other replaceable items.

The Organiser reserves the right to announce the name of each winner through Facebook, SMS, publication in magazines, newspapers, on the Internet and at the company’s offices. By participating in the Competition, participants are presumed to have granted their consent to such disclosure of their names.

The Organiser reserves the right to request from each winner to give his/her written consent, at the free and uninfluenced will of each winner, for the use of their minimum personal data necessary on the Competition webpage or in the context of any other promotional action related to the Competition.

4. Terms and conditions for awarding of AEGEAN Miles+Bonus miles:
• The miles awarded are award miles, not tier miles.
• The Participant’s personal information must match that of his/her AEGEAN Miles+Bonus account.
• Miles are awarded to a specific winner and cannot be transferred to another person, nor sold or exchanged for cash.
• The miles will be credited to the accounts of the winners within 10 working days of the date of their notification.

5. Date of start-end of Competition/promotion – Duration
The Competition / Promotion will start at 15:00 hours on Thursday, 13 December 2018 and will end at 12:00 hours on Wednesday, 2 January 2019. The Competition computers (including any automated subsystems – count-down web tools made available to the Organiser) shall be the official timer of the Competition determining the Start Time, the End Time as well as the time an entry in the Competition is actively sent. It is hereby explicitly specified that, after the end date and time of the aforesaid Competition/promotion, as announced in the terms of use of the Organiser’s page and posted on Aegean’s website during the last Competition procedure, no participation shall be accepted by, or be binding upon, the Organiser as far as participation in due time is concerned.

6. Change of terms and conditions of use:
The Organiser reserves the right to amend these terms at its discretion, informing visitors/users about any amendments and changes through the Competition/promotion webpage at www.aegeanair.com

7. EXPRESS DECLARATION – CONSENT – ACCEPTANCE BY THE PARTICIPANTS
All participants in the Competition hereby fully and unreservedly accept these terms and conditions of use. Persons who do not accept the terms and conditions of use should not participate in the Competition. Furthermore, all participants explicitly and unreservedly acknowledge, state and accept that:
(a) the personal data provided in the context of this promotion may not belong to any third party, whether a natural person or legal entity, but only to themselves;
(b) they are over the age of 18;
(c) their privacy is neither violated nor degraded in any manner whatsoever due to their participation in the Organiser's promotion;
(d) they do not infringe personal data or privacy rights of any third party;
(e) they do not infringe intellectual property rights of any third party;
(f) they expressly consent and allow the Organizer to use their personal data (full name, telephone, e-mail address) for the purposes of the Competition;
(g) they grant their expressly consent and authorisation to the Organiser to promote the Competition and its results through the print and electronic press and through the Internet for its entire duration. The Organiser reserves the right to use and publish any news relating to the conduct of the Competition;
(h) they grant their expressly consent and authorisation for exploiting any relevant event through advertising, without requiring any further notice or any compensation. The Organiser also reserves the right to publish audiovisual material from the draw and the Prize-giving event.
8. Publicity
The terms of participation in the Competition have been deposited with Athens-based notary public Haralambos Fotopoulos, 47 Solonos St., Athens GR-10672, tel. +30 210 3617704, and have been posted on the Competition webpage www.aegeanair.com. The draw will be held at Aegean’s offices at 31 Viltanioti St, GR-14564 Kifissia, on Thursday, 3 January 2019, at 15:00 hours. Two hundred (200) winners will be selected. Any participant in the Contest or third party is entitled to obtain a copy of this act or any modification of this act at his own expense.

9. Withdrawal of Notice – Amendment of Terms - Liability
The Organiser shall be entitled to withdraw the Competition notice, in whole or in part, or to amend these terms (including the duration of the Competition and the dates of conduct of the draws), or to change the Prizes offered during or after the Competition. In this case the Organiser shall bear no liability whatsoever for any compensation with regard to the winners of that draw. The Organiser shall bear no liability under any circumstances for any direct or indirect losses, expenses or costs which may arise from any interruption, malfunction, delay or any other reason, concerning the Competition prizes. Furthermore, the Organiser hereby waives all liability, whether criminal or civil, to any winner or third party, for any accident and/or loss and/or bodily injury or material damage that may occur to the winners, directly or indirectly, relating to the Prizes or arising from any other cause. It is expressly understood that, after the end of this Competition or after the new date that may be set following any postponement or change in the duration of the Competition, entries shall no longer be possible and any entries submitted shall automatically be considered null and void and shall not be binding on the Organiser and/or any other third party. In that case, by participating in this promotion, participants irrevocably accept that they do not acquire any right or claim against the Organiser nor do they become entitled to demand continuation of the Competition that has ended or delivery of the Prizes not awarded or any further compensation. Participants shall neither have nor acquire any rights whatsoever in respect of the trade marks, names, marks, logos and other insignia of the Organiser.

10. Personal Data - EXPRESS Consent: Regarding the Organiser
Participation of any person in this Competition implies the participant's automatically unreserved consent to the Organiser responsible for monitoring and implementing the competition using their details, to create personal data files (personal data). The database created as a result of this Competition may be used by the Organiser for promotional purposes in the future, to promote its own services. Participants in the Competition agree to the Competition database being handed over by the Organiser to the company responsible for monitoring and implementing the Competition and vice versa.

11. Applicable Law – Jurisdiction
These terms and conditions and all types of contractual and non-contractual relations arising as a result of their implementation shall be governed by Greek law for all participants. Any dispute to arise in the future in relation to this Competition shall be referred exclusively to the Courts of Athens, including by non-permanent residents of Greece.

ANNEX - "DECLARATION OF CONSENT"
The participant declares that he/she has been fully informed of all the Analytical Terms of the competition, which he/she accepts unreservedly in their entirety. Each participant declares that he/she has no claim, existing and/or future against the Organiser, its managers, employees and assistants of its completion regarding the conduct of the competition, the implementation of the terms, or any other cause associated directly or indirectly with the competition.

Each participant expressly accepts and consents to the simultaneous assignment as well as to the complete and definitive transfer of all the intellectual property rights of the above visual material to the Organiser without any consideration, the latter being entitled to employ in any way the visual material for the creation of online and offline advertisement, on the Internet, and/or in the printed press and/or on television.

PERSONAL DATA PROTECTION STATEMENT
"AEGEAN AIRLINES SA", with registered office at 31 Viltanioti Street, Kifissia, Attica, (hereinafter the ‘Company) is responsible for the processing of your personal data in connection with your participation in the “Your wish can take you miles away" competition / promotion. With the strategic goal of ensuring the utmost protection of the participants' personal data, we consider it our duty to inform you of our practices as well as your choices and rights.

Ι. What personal data do we collect
For your participation in the competition, our company collects and processes your name and surname, your e-mail address and your date of birth. You provide this information with the relevant forms of participation in the competition.

ΙΙ. For what purposes do we collect and process your personal data
We collect and process your personal data solely to enable you to participate in the competition and to identify you. At a later stage and if you are selected as a winner, we will process your personal data only if you give us your explicit consent in order to promote the Company's campaign to the general public. In particular, our company will process the following data (surname, e-mail address) in relation to the competition prize for the promotion of the campaign through any of the company's online and offline channels (Internet, mobile applications, third party websites, Social Media, YouTube, Airport Monitors, inflight Entertainment programs, etc.), as well as the Internet, for as long as and wherever deemed necessary by the Company. In addition, and if you expressly wish to do so, and have completed the relevant consent field on the participation form, our Company may process your data to promote products and services to you by e-mail.

III. Who do we disclose and/or pass on your personal data to?
Our Company may pass on, disclose or grant access to your personal data to companies that will operate in the name and on behalf of the Company in order to facilitate the achievement of its purposes.

VI. How do we safeguard the protection of your personal data?
In order to ensure the proper use and integrity of the collected personal data, as well as to prevent unauthorised or random access, processing, deletion, distortion or other use thereof, our company implements a range of internal policies, while adopting all the necessary organisational, technical, physical, electronic and procedural safety measures, as well as technological standards in accordance with the applicable Laws and Regulations.

VII. How long do we keep your personal data for?
We keep your personal data for as long as necessary for the completion of the competition and/or for the purposes for which you have provided us with your consent. Then, the data is deleted from our records and our system in accordance with our business policy and provided that their keeping is no longer required to fulfil the purposes we have described above or to meet our business, tax or accounting requirements or to defend our rights before any competent Court or any other authority.

VΙII. What are your rights?
You have the right to request and to be given access, information and a copy of your personal data that we collect and process. If you desire a copy of part or of all your personal data, please contact us using the company’s contact details listed in the relevant section of this document "ΙΧ. How to contact us”.

Furthermore, we would like to inform you that you have the right to request the deletion of your personal data if (a) they are no longer necessary for the fulfilment of the purposes of our contractual relation, (b) they have been unlawfully processed and beyond the purposes described in detail herein, (c) it is required by Law.

Moreover, you have the right to revoke your consent (entirely or partially) regarding the collection and processing of your personal data by our company. In this case, please note that any withdrawal of your consent in no way affects the legitimacy of the processing until the moment of revocation. Therefore, you may freely withdraw all or any of your given consent at any time by submitting your written request to the e-mail address provided below under term IX How to contact us, so that the photographs and/or the audiovisual material in which you appear will be deleted and as a winner only your name will be mentioned. Please note that the said deletion obligation obviously does not apply to photographs that have already been included in previously released material. In addition, in the case of photographs/audiovisual material where more people are depicted, your refusal to consent to your appearance or the subsequent withdrawal of your consent does not entail the destruction of all photographs/audiovisual material but only the blurring of your own image (face and body) so that the person being depicted is not identifiable. In the event that your consent is revoked, we will take reasonable steps to inform third-party data processors.
